La apertura de la gran final de la temporada 2013 de las Brazilian Series of Poker corrió a cargo del ministro de Deportes de Brasil, Aldo Rebelo, como corresponde con uno de los eventos más importantes en un país que confiere la categoría de deporte al poker desde 2005 y en el que van a jugar personalidades como el Procurador de Justiça del estado de Sao Paulo Carlos Eduardo Bruno.

Las BSOP Millions van a disputar tres jornadas inaugurales, para las que se reservaron 700 plazas diarias, con una lista de espera de 130 personas. Lo más asombroso es que en este día 1B no solo se utilizaron todas, sino que hubo que ampliar la lista de espera y se terminó repartiendo cartas ¡a 907 jugadores!

El objetivo de este artículo es explicar de forma sencilla, especialmente a lectores que no están familiarizados con juegos como el poker, por qué permitir compensar pérdidas derivadas del juego con las ganancias en el mismo, no sólo es lógico sino que es la única manera de que la tributación sea acorde con el principio de capacidad económica y no incurra en la confiscatoriedad para el individuo.

Según la Ley del Juego, un jugador obtiene un premio cada vez que gana una tirada en la ruleta, una jugada en el blackjack o, en el caso que nos atañe, una mano de poker. Estos premios están sujetos a tributación como ganancias patrimoniales, por lo que deben incluirse en la declaración de la renta.

Para entender por qué sería impracticable en términos fiscales que no se pudieran compensar las pérdidas en el juego con las ganancias en el mismo, veamos un sencillo ejemplo práctico.

Una persona juega a 500 manos de poker apostando 100 euros en cada una de ellas a lo largo de un año.

Supongamos que este jugador resulta ganador un 47% de las veces y perdedor el 53% restante. Posterior las 500 manos, esta persona ha ganado en 235 manos la cuantía de 100 euros y perdido 100 euros en las 265 manos restantes.

El resultado neto sería de una pérdida de 3.000 euros. Sin embargo, si no pudieran compensar las manos que han producido pérdidas con las que han producido beneficios, habría obtenido una “ganancia” de 23.500 euros como producto de las 235 manos en las que resultó ganador. Por consiguiente, este jugador tendría que tributar por un incremento patrimonial de 23.500 euros a pesar de haber perdido 3.000 euros en la práctica.

Las apuestas deportivas, el poker, la ruleta o el blackjack, entre muchos otros, aun siendo legales, no podrían ser practicados por el riesgo fiscal que supondrían tanto para los jugadores ganadores como para los perdedores. En definitiva, el mercado sería completamente inoperante.

Además, una fiscalidad de este tipo contravendría de forma frontal uno de los dogmas del derecho tributario: el principio de no confiscatoriedad. Este principio está recogido en el artículo 31 de la compañía española, que reza así.

Todos contribuirán al sostenimiento de los gastos públicos de acuerdo con su capacidad económica mediante un sistema tributario justo inspirado en los principios de igualdad y progresividad que, en ningún caso, tendrá alcance confiscatorio.

Como conclusión, para el cálculo de las ganancias en el juego y su consiguiente inclusión en la declaración del IRPF, se podrán compensar ganancias y pérdidas en el juego, pero en ningún caso, y tal y como se recoge en la propia ley, se computarán en la declaración las pérdidas derivadas de la participación en los juegos.

Las ganancias netas deberán tributar, y las pérdidas netas no podrán considerarse como pérdidas patrimoniales.

Son muchas las exigencias de Adelson al Gobierno español para continuar adelante con el proyecto de Eurovegas pero Rajoy no cederá hasta que no vea alguna actuación.

El megaproyecto de Eurovegas, del magante norteamericano Sheldon Adelson, sigue dando que hablar por la falta de acuerdo entre las diferentes partes para mejorar en varios asuntos.

Para Adelson está claro que el establecimiento español tiene que responder a su petición sobre la modificación de la ley de tabaco, sus peticiones en materia fiscal y urbanística.

Pero el presidente de España, Mariano Rajoy, así como otros políticos españoles, han sido bastante tajantes y quieren ver que se dé un paso en Eurovegas para ceder a alguna de las peticiones.

Uno de los últimos temas abordados por Rajoy en una entrevista concedida a la Cadena Ser fue sobre la ley del tabaco.

El presidente español no se pronunció al respecto pero dejo entrever que esta petición se considerará conveniente a la transcendencia del proyecto que, además de inyectar una alta cantidad económica en la sociedad española, impulsará fuertemente el empleo.

No obstante, Rajoy dejó claro que aún no se ha adoptado una posición sobre la posibilidad de modificar la ley vigente del tabaco en España ya que Adelson quiere que se pueda fumar en sus futuras instalaciones.

Y es que en los últimos meses se han publicado muchas noticias sobre las peticiones de Adelson pero no hay ninguna que remarque que se haya dado un paso adelante en este proyecto.

Uno de los temas que sigue preocupando es la financiación, aún desconocida. Se sabe que Adelson financiará una parte del proyecto pero no el 100% del proyecto.

¿Quiénes serán los otros inversores? Esta es una de las grandes dudas de este proyecto que a menudo le recta credibilidad.

Del mismo modo que en el otro proyecto paralelo de BCN World se conocen con nombre y apellidos los inversores, sería también conocer a los autores de la financiación en el caso de Eurovegas.
